ONSC's Liability Release, Waiver, and Agreement:

 

 

I understand that ONSC is committed to protecting the health and wellbeing of staff and visitors.

 

I consent on behalf of myself and/or my child/ward to enter into the ONSC programs and activities voluntarily, and I take full responsibility for the decision for myself and/or my child/ward to participate or not to participate. I agree to allow ONSC staff, who are trained in First Aid and CPR, to treat myself and/or my child/ward for any illnesses and injuries, and I understand that in the case of a sting, bite, or other allergic reaction, ONSC staff trained in First Aid will administer oral antihistamines and/or epinephrine if necessary. 

 

I understand that during my and/or my child/ward's participation in this Ozark Natural Science Center (ONSC) program, event, or workshop, I or my child/ward may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent in each program and cannot be eliminated without destroying the unique character of the program. These inherent risks include, but are not limited to, the dangers of serious personal injury, property damage, and death (“Injuries and Damages”) and ONSC has not tried to contradict or minimize my understanding of these risks. I know that Injuries and Damages can occur by natural causes or activities of other persons, animals, trip members, trip leaders and assistants or third parties, either as a result of negligence or because of other reasons. In consideration for my or my child/ward's acceptance as a participant in this program, and the services and amenities to be provided by ONSC in connection with the program, I confirm my understanding that: 

- I have read any rules and conditions applicable to the program made available to me; 

- I will pay any costs and fees for the program; and I acknowledge my participation is at the discretion of ONSC. 

- The program officially begins and ends at the location(s) designated by ONSC. 

- If I decide to leave early or pick up my child/ward early and not to complete the program as planned, I assume all risks inherent in my decision and waive all liability against ONSC arising from that decision. I understand that only the adults listed on the registration form will be allowed to pick up my child/ward, and a photo ID will be required.

 

This Agreement is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable. To the fullest extent allowed by law, I agree to WAIVE, DISCHARGE CLAIMS, AND RELEASE FROM LIABILITY ONSC, its officers, directors, employees, agents, and leaders from any and all liability on account of, or in any way resulting from Injuries and Damages, even if caused by negligence of ONSC, its officers, directors, employees, volunteers, agents, and leaders, in any way connected with this program. I further agree to HOLD HARMLESS ONSC, its officers, directors, employees, volunteers, agents, and leaders from any claims, damages, injuries or losses caused by my or my child/ward's own negligence while a participant on the outing. I understand and intend that this assumption of risk and release is binding upon my heirs, executors, administrators and assigns, and includes any minors accompanying me on the program. 

 

COVID-19 Protocols: ONSC is committed to protecting the health and wellbeing of our staff and visitors. Below are the safety precautions that will be taken during ONSC’s Programs, Events, and Workshop to mitigate the spread of COVID-19. Masks are optional for visitors at this time. Participants should stay home if they:

- Feel unwell in any way

- Are awaiting COVID-19 test results

- Have been exposed in the past 14 days: Exposure is defined as being with someone who has COVID-19 or is suspected of having COVID-19 while you were: Within 6 feet for more than 15 minutes during a 24-hour period; Masked or unmasked; Indoors or outdoors; Had direct physical contact with the individual; Shared eating or drinking utensils; Coughed or sneezed on

- Individuals that are at a heightened-risk for COVID-19 should consult their doctor if there is any concern over the risk of attending an event.

 - Even with precautions and safety measures, there is still a possibility of contracting COVID-19 at ONSC. By attending ONSC’s Workshop or Event and signing this release, waiver and agreement, participants acknowledge they will do their best to help prevent the spread of COVID-19 and know that there is always a risk even with training and enhanced safety measures. 

 

I have read this document in its entirety and I freely and voluntarily assume all risks of such Injuries and Damages and notwithstanding such risks, I agree for myself and/or my child/ward to participate in the program.
